Smoking Policies in Clark County, Nevada: What Businesses Need to Know

Businesses in Clark County, Nevada must be aware of the regulations regarding smoking policies. All supermarkets, convenience stores, pharmacies, restaurants, and casinos or gaming establishments must post signs about their smoking policies. The no-smoking area must be a minimum of 30 feet away from the entrance or exit of any public building, so that no person entering or leaving the building can smell smoke. The Department of Health and Human Services takes into account the impact of any suspension or revocation of a license on the inventory of cigarettes or other tobacco products that are in circulation at the time of suspension or revocation.

This includes the physical inventory of cigarettes in packages with a Nevada stamp placed in the possession or control of the wholesaler for sale or distribution within the borders of this state, available at the start and close of operations on the first and last days of the month. The physical inventory of cigarettes in packages with the seal of another state placed in the possession or control of the wholesaler for sale or distribution outside the borders of this State will also be available at these times. The Department also considers the licensee's promptness in correcting any inaccurate information included in a report or certification required by this chapter. The directory will not include or maintain in it the name or brand families of any non-participating manufacturer that has not provided the required certification or whose certification the Department determines is not in compliance with NRS 370,600 to 370,705, inclusive, unless the Department has determined that the violation has been satisfactorily rectified.

When calculating, any cigarette from a non-participating manufacturer that was sold or distributed in this State or in this State by a wholesaler during the calendar quarter in which the wholesaler collected and deposited the required escrow amount on or before the due date for that quarter's deposits must be excluded from both the numerator and denominator of the fraction.
